Red Cross Assists Hamas in Search for Bodies of Captives in Gaza Strip

The International Committee of the Red Cross (ICRC) confirmed that its representatives accompanied members of Hamas into zones of the Gaza Strip currently controlled by IDF control to facilitate the hunt for the remains of Israeli hostages.

Ceasefire Agreements and Hostage Bodies Handover

As part of the truce negotiated by the United States, which began on October 10, the group is required to return the remains of all captives promptly. As a reciprocal measure, Israel has consented to transfer 15 Palestinian bodies for every Israeli body returned.

Hamas has to date handed back the bodies of fifteen of those held captive but none in the past five days, as a portion of those remains are believed to be in areas beyond the yellow line marking Gaza’s ceasefire.

ICRC Involvement as Neutral Intermediary

“Upon the appeal of the involved sides, the International Committee of the Red Cross (ICRC) joined a party to the conflict as the group searched for the bodies of the deceased individuals beyond the IDF-designated ‘yellow line’,” said a representative for the committee.

She added: “Those involved to the conflict established the procedures of the mission and delegated the ICRC to act as a neutral intermediary. We was not involved in the discussions.”

She further explained: “The ICRC was not involved in the physical hunt for the deceased nor does it engage in the physical recovery of remains.”

International Humanitarian Law and Duties

Under global legal norms, it is the responsibility of the sides engaged in a hostilities to locate, collect, and recover the bodies of the deceased.

American Demand and Local Search Efforts

Recently, the US president delivered a two-day demand to the militant group. “Hamas is going to have to begin returning the bodies of the deceased hostages, which include two Americans, promptly, or the additional nations involved in this significant truce will intervene,” he wrote on his online channel.

As the 48-hour deadline approached, the group, accompanied by the Red Cross, teamed up with Egyptian teams, who were authorised by Israeli authorities to search for bodies beyond the boundary indicating the Israeli military’s pullback inside the territory. An official representative said the delegation would use excavator machines and vehicles in the operation.

The news was corroborated by an source within Israel, who told Hebrew-language media that Hamas representatives had been permitted to enter areas of the region under military authority to search for the remains of hostages, alongside Egypt’s and ICRC personnel.

“For this purpose, Hamas members were permitted to pass the designated boundary,” the official was quoted as saying.

Footage published by a media outlet seemed to show members of a specialized group – belonging to the organization’s armed faction tasked with holding hostages – escorting a humanitarian transport in a coastal area close to a southern city, which is beyond IDF jurisdiction.

Challenges in Locating Hostage Remains

Efforts to locate for the remains of individuals taken captive has turned into one of the most delicate matters in the ceasefire agreed between the two sides. However, the effort to locate the bodies has been challenging from the beginning, given the existence of an estimated enormous amount of debris across the territory, where, as per local health authorities, at least 10,000 Palestinians are recorded as unaccounted for, buried under the rubble.

Conflicting Claims on Remains Whereabouts

The group has claimed it does not know the exact locations of all the bodies, saying it has lost contact with a number of its units that had been detaining the hostages and were allegedly eliminated during military strikes.

In contrast, an official representative claimed that the organization was aware of the whereabouts of the bodies. “Should the group exerted greater effort, they would be able to recover the remains of our captives,” the official said.

American Stance and Disarmament Talks

While the US president has acknowledged that some of the bodies are hard to reach, he said that “others they can hand over immediately and, for unknown reasons, they are failing to do so.”

“It may have to do with the disarming of Hamas,” he noted.

The US administration has said it has obtained assurances from the organization that the faction will surrender its arms, though no clear timeline has been established. They remains hesitant to surrender its arms without solid assurances about the future of its members.
