A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The case originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his repatriation to the United States to answer human smuggling charges, he was detained in federal detention.

In her order, the court noted that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
